These Website & Messaging Terms of Use (“Terms”) govern your access to and use of The Field of Being website, sales pages, registration pages, content, services, programs, products, courses, communications, community features, and related services offered by Kristen Bomas MS, P.A., doing business as The Field of Being (“Company,” “we,” “us,” or “our”).

Our primary website is TheFieldofBeing.com.

By accessing or using our website or Services, you agree to these Terms. If you do not agree, please do not use the website or Services.

These Terms may work together with purchase-specific terms, program agreements, our Privacy Policy, and other terms presented to you at registration or checkout.

1. Who We Are and How Our Services May Be Used

Kristen Bomas MS, P.A., doing business as The Field of Being, provides educational and informational content and services that may relate to:

  • relationships
  • personal development
  • self-understanding
  • self-mastery
  • spirituality
  • educational courses and programs
  • live and virtual events
  • speaking engagements and presentations
  • books, written works, recordings, and other educational materials

The website and related pages may allow you to:

  • learn about our programs, courses, events, and services
  • access educational materials, videos, articles, and other content
  • subscribe to email communications
  • voluntarily subscribe to SMS or MMS communications
  • register for events, webinars, courses, or digital programs
  • purchase products, programs, events, or services
  • participate in online communities or discussion areas

All educational content is intended for general informational and educational use.

2. Educational Information and No Professional Relationship

Content offered through The Field of Being is educational in nature.

Participation in a course, event, program, community, website, email communication, text-message program, or other educational offering does not create a therapist-client relationship with Kristen Bomas or Kristen Bomas MS, P.A.

The Services are not psychotherapy, mental-health treatment, diagnosis, medical treatment, legal advice, financial advice, or a substitute for care from a qualified professional who is treating or advising you directly.

You remain responsible for your own choices, actions, and decisions.

Examples, stories, case illustrations, testimonials, or participant experiences are provided for educational or illustrative purposes. Individual experiences and results vary. We do not promise any particular personal, relationship, financial, professional, or other result.

3. Eligibility and Age Restrictions

You must be at least 18 years old to purchase or participate in our Services unless we expressly state otherwise in writing.

By using the website or Services, you represent that you are legally able to enter into these Terms.

Our Services are not directed to children under 13, and we do not knowingly collect personal information online from children under 13 without legally required authorization.

Your use of our website and Services is also subject to our Privacy Policy.

We may restrict or terminate access when we reasonably believe these Terms have been violated.

6. Intellectual Property and Limited License

All original content provided through The Field of Being is owned by or licensed to Kristen Bomas MS, P.A. and is protected by applicable copyright, trademark, and other intellectual-property laws.

Protected materials include, without limitation:

  • The Sage’s Template™
  • The BRIDGE Method™
  • proprietary educational frameworks and teaching systems
  • course structures and curricula
  • exercises and teaching tools
  • workbooks and worksheets
  • written materials
  • presentations and slide materials
  • videos and recordings
  • audio materials
  • graphics and illustrations
  • stories and educational examples
  • website copy and design
  • downloads
  • logos and brand assets
  • other original educational or proprietary material

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use purchased or provided materials for your own personal educational use.

Unless you receive prior written permission from us, you may not:

  • reproduce or republish our materials
  • record or distribute program content
  • share course materials or login credentials
  • sell, sublicense, or transfer access
  • modify our materials for commercial use
  • create commercial derivative works from our proprietary materials
  • teach, license, distribute, or commercially use our proprietary frameworks as your own
  • use our name, marks, logos, or branding in a way that suggests authorization, endorsement, or affiliation

All rights not expressly granted remain reserved by Kristen Bomas MS, P.A.

7. Purchases, Programs, Events, Courses, and Digital Products

When you purchase a course, program, event, membership, digital product, or other offering, you agree to provide accurate purchase and account information.

Unless we expressly state otherwise in writing:

  • purchases are intended for the individual purchaser
  • access may not be shared, resold, sublicensed, or transferred
  • program materials may not be copied or distributed
  • all sales are final
  • purchases are non-refundable except where a refund is required by applicable law

Kristen Bomas MS, P.A. retains sole discretion to make an exception to the no-refund policy when we believe an exception is appropriate. A discretionary refund, credit, accommodation, or other exception in one situation does not create a right to the same exception in another situation and does not change our general no-refund policy.

Where access to an educational offering is provided for a stated period, we may, in our sole discretion, grant an additional one month of access as an accommodation.

An access extension:

  • is not guaranteed
  • is not transferable to another person
  • does not constitute enrollment in another program or future offering
  • does not create an ongoing right to additional extensions

Terms displayed at checkout or provided specifically for a purchased program may add terms relating to access periods, payment plans, participation, community access, scheduling, or other features of that offering.

Unauthorized Sharing

Course accounts, digital products, recordings, training materials, workbooks, community access, and other paid resources are provided only to the authorized purchaser unless we expressly state otherwise.

Unauthorized copying, credential sharing, reproduction, resale, distribution, or publication may result in termination of access and other remedies available under law.

No Guarantee of Outcome

Participation requires personal judgment, participation, practice, and application. We do not promise that any course, event, program, teaching, or resource will produce a particular relationship, emotional, personal, financial, career, or professional outcome.

8. SMS and Text Messaging Terms

The Field of Being may offer one or more voluntary SMS or MMS messaging programs.

Text messages may be sent by The Field of Being, operated by Kristen Bomas MS, P.A.

You will receive text messages only when you separately opt in to the applicable messaging program or otherwise provide valid consent.

Separate Consent

Consent to receive text messages:

  • is voluntary
  • is not required as a condition of purchasing any product or service
  • must be provided separately from acceptance of general website terms or the Privacy Policy
  • will apply only to the type of messaging program for which you provided consent

Where we offer more than one category of text messages, such as event or transactional notices and promotional marketing messages, we may request separate consent for each category.

Types of Messages

Depending on the messaging program you choose, messages may include:

  • event registration confirmations
  • event reminders
  • schedule information
  • access or program notices
  • educational updates
  • service-related information
  • promotional offers or marketing messages when you have separately consented to promotional messaging

Automated Messaging

Where permitted by law and covered by your consent, messages may be sent using an automated telephone dialing system, automated messaging platform, or similar technology.

Message Frequency

Message frequency varies based on the program, event, purchase, or communications you select.

Rates

Message and data rates may apply. Your mobile carrier’s terms and charges apply.

How to Stop Messages

You may withdraw your consent to a messaging program at any time by replying STOP to a message from that program.

After we process your request, you may receive a final confirmation message stating that you have been unsubscribed.

If you later wish to receive messages again, you may opt in again through an available enrollment method.

Carrier Responsibility

Wireless carriers are not liable for delayed or undelivered messages.

Mobile Information and Consent Data

We do not sell, rent, or share mobile telephone numbers or SMS opt-in consent data with third parties or affiliates for their own marketing or promotional purposes.

We may provide mobile information to vendors or service providers when needed to operate our messaging system, deliver requested communications, provide technical support, maintain records, prevent fraud or misuse, or comply with law.

Any such use is limited to providing services on our behalf and is subject to applicable privacy and contractual requirements.

9. Email and Marketing Communications

When you separately subscribe to email communications, register for a program, download a resource, or provide an email address for an appropriate business purpose, we may send communications permitted by applicable law.

These may include educational content, registration information, program information, announcements, and promotional communications.

You may unsubscribe from marketing emails at any time through the unsubscribe link included in those messages or by contacting: [email protected]

An unsubscribe request from marketing email does not prevent us from sending necessary transactional, account, security, purchase, program-access, or administrative communications.

10. User Submissions, Feedback, Messages, and Testimonials

You may have opportunities to send us feedback, questions, ideas, messages, comments, or other material.

You retain ownership of content that you own.

Submitting private correspondence, a community message, a form response, feedback, or other communication does not automatically give us permission to use your identity, words, story, photograph, likeness, or personal experience for advertising or promotional purposes.

We may use general feedback internally for legitimate business purposes, such as improving our educational programs, customer experience, website, or Services.

If you voluntarily post content in a public or member-visible area, you grant us the limited permission reasonably required to host, display, store, and make that content available within the area in which you posted it.

We will not treat a private message, community contribution, course response, or other submission as a marketing testimonial merely because you provided it to us.

If we wish to use your identifiable words, story, image, likeness, or testimonial in advertising, public marketing, or promotional materials, we will seek separate permission when permission is required.

You may not submit material that you do not have the right to share.

You are responsible for the information you choose to share.

Please respect your own privacy and the privacy of other participants.

Do not post another person’s private, confidential, medical, financial, identifying, or personal information without proper authorization.

Participants should not copy, photograph, record, distribute, or publicly repost another participant’s personal story, message, image, comment, or contribution without that person’s permission.

Where a platform permits it, participants may choose to use a display name or pseudonym rather than publicly displaying identifying information, subject to platform rules and any account information required for administration or payment.

Community participation is educational and is not psychotherapy, group therapy, crisis care, or a therapist-client relationship.

We may moderate, edit, restrict, remove, or disable content or access when reasonably needed to operate the community, protect participants, enforce these Terms, or comply with law.

12. Third-Party Links, Platforms, and Services

We may use or link to third-party websites, payment processors, video platforms, community platforms, email providers, SMS providers, course platforms, scheduling tools, and other services.

Those providers operate under their own terms and privacy practices.

We are not responsible for the independent acts, policies, security practices, or content of third-party providers outside our control.

13. Disclaimer of Warranties

To the fullest extent permitted by law, our website, educational materials, products, programs, and Services are provided on an “as is” and “as available” basis.

We do not warrant that:

  • access will always be uninterrupted
  • all technical errors will be corrected immediately
  • third-party platforms will always remain available
  • website content will always be free of technical defects
  • any particular result will arise from participation in our Services

Nothing in these Terms limits rights that cannot legally be waived.

14. Limitation of Liability

To the fullest extent permitted by applicable law, Kristen Bomas MS, P.A., The Field of Being, and their officers, employees, contractors, agents, licensors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from the use of or inability to use the website or Services.

To the fullest extent permitted by law, total liability for a claim arising from a purchased Service will not exceed the amount paid by you to Kristen Bomas MS, P.A. for the specific Service giving rise to the claim during the twelve months preceding the event giving rise to the claim.

Nothing in this section excludes liability that cannot legally be excluded.

15. Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless Kristen Bomas MS, P.A., The Field of Being, and their officers, employees, contractors, agents, licensors, and service providers from claims, liabilities, losses, costs, or expenses arising from:

  • your unlawful use of the website or Services
  • your material violation of these Terms
  • your infringement of another person’s rights
  • content you submit without the legal right to submit it

This provision does not require you to indemnify us for conduct for which indemnification may not lawfully be required.

16. Right to Refuse or Restrict Service

To the extent permitted by law, we may refuse or restrict service, cancel access, suspend an account, remove content, or terminate participation when there is a lawful business, safety, conduct, payment, program-integrity, or policy reason to do so.

Terms specifically governing a paid program or recurring service will control where they address cancellation, access, renewal, or payment obligations more specifically than these Terms.

17. Termination

We may suspend or terminate access if we reasonably believe:

  • these Terms have been materially violated
  • another person’s safety or rights are at risk
  • misuse or unauthorized distribution has occurred
  • continued access would expose the Company, participants, or service providers to significant legal or operational risk

Terms concerning intellectual property, payment obligations, privacy, liability, dispute handling, and other provisions that are intended by their nature to survive termination will remain in effect.

18. Governing Law and Dispute Terms

These Terms are governed by the laws of the State of Florida, subject to any consumer protection rights that cannot legally be waived.

Where another written agreement or the Company’s general Terms and Conditions contains a dispute-resolution procedure that applies to your purchase or participation, that procedure will govern the dispute.

Nothing in this document is intended to replace or contradict a dispute-resolution provision contained in an applicable purchase agreement or in the Company’s general Terms and Conditions.

If no other applicable dispute-resolution provision governs a matter, the parties agree to make a good-faith attempt to resolve the matter informally before pursuing formal legal proceedings.

19. Changes to These Terms

We may revise these Terms from time to time to reflect changes in our Services, messaging practices, legal requirements, carrier requirements, technology, or business operations.

When revisions are made, we will update the “Last Updated” date.

Revised Terms will generally apply prospectively from the date they are posted or otherwise communicated.

A revision to these website or messaging Terms will not, merely by being posted, retroactively remove or materially alter a specific contractual right that applied to a completed purchase.

Where applicable law or the nature of a material change requires additional notice or consent, we will provide it.

Your continued voluntary use of a Service after revised Terms become effective may constitute acceptance of those revised Terms to the extent permitted by law.

20. Relationship to Other Agreements

These Terms govern use of our website, funnel pages, communications, and related Services.

They may supplement:

  • purchase-specific checkout terms
  • course or program agreements
  • community rules
  • event terms
  • our general Terms and Conditions
  • other written agreements expressly applicable to a particular Service

If a purchase-specific written term directly conflicts with a more general provision here, the more specific term will govern that purchase to the extent of the conflict.

These Website & Messaging Terms are not intended to create a second conflicting set of company-wide contractual rules.
